, the focus returns to remembering the victims. ceremonies in new york, virginia and pennsylvania pay tribute to the 2,752 victims killed when terrorists hijacked four commercial planes and attacked the u.s. in lower manhattan, 9/11 families gather at zuccotti park, adjacent toground zero. throughout the morning, as has become tradition, victims of moments l be read and of silence will be marked when each plane hit and each tower fell. at the pentagon, president obama delivers remarks and participates in a wreath-laying ceremony at the memorial site. and in shanksville, pennsylvania, where united flight 93 crashed, first lady michelle obama, along with former first lady, laura bush, attend a ceremony to honor the passengers who foughback. meanwhile, plans to rebuild at ground zero are moving forward. the centerpiece, one world trade center, is expected to be completed by 2013. but with each construction step forward,here remains a connection to the past. steel beams pulled from the ground zero rubble were permanently installed this week at the entrance of the national september 11th memorial

of republicans. in a moment, lieutenant dan choi. virginia phillips ruling the policy of banning openly gay men and women from serving in the military has a, quote, direct and deleterious effect on the armed services. phillips declaring don't ask, don't tell is unconstitutional because it violates first and fifth amendment rights, and offers no military benefit. among those discharged were many with critically needed skills. according to the government's own data, many of those discharged pursuant to the act had education training or specialization in so-called critical skills, including arabic, chinese flun see. military intelligence, weapons development and medicine. the suit was first filed in 2004 by the republicans, a gay and lesbian advocacy group. it will not effect policy immediately. the judge will first draft an injunction over the next week. the justice department can appeal the decision. a spokesman telling the ap, it's currently being reviewed by attorneys. for his part, president obama who campaigned on the repeal of don't ask, don't tell has left it up to congress to overturn the

as their fifth amendment rights to due process. judge virginia phillips also said she would issue an injunction to keep the government from enforcing what she ruled as a due process denying free speech-violating policy. the justice department has not yet said whether it will appeal the judge's decision. the justice department spokesman did say that lawyers are reviewing the ruling. as for the commander in chief, well, he didn't have to say anything about it today. president obama was not asked a single question about the ruling at today's press conference. which, frankly, i thought was weird. but the justice department may have for its part already tipped its cards a little bit on this issue. the justice department mounted a really, really, really bad defense in this case. so bad as to be almost nonexistent. we learned this today not from the justice department, but from are judge phillips in her 85-page decision. she noted on page 20 of that decision, quote, apart from the act itself and its legislative history, defendants, meaning the government, admitted to evidence, and produced no witnesse
